Hi John
If it were mine I would not MOTtest it. I think this would come under the for hire or reward clause. The vehicle may be able to have a dual pupose because of its twelve seats but you are only using it for one pupose ie: social domestic and pleasure , to and from work etc. If the vehicle was licensed by your local council for hire and reward and you had insured it for the same then you would have to meet the Dot requirements for a vehicle of this type, a class 5 annual mot test regardless of vehicle age.
Should the police stop you they would be unable to enforce the annual mot requirement and prosecute as you would not have the vehicle insured for this or licensed by the local council, thus proving the single purpose use.
The things that can convict you can also exempt you from prosecution.
If you are still unsure write to your insurers,the police and the DoT and mention your intended use of the vehicle and ask for clarification from their point of view and keep all the replys.
